REGULATION FOR THE USE OF KOIDULA BORDER CROSSING WAITING AREA



1. GENERAL PROVISIONS

1.1. The regulation (hereinafter Regulation) for the use of Koidula Border Crossing Waiting Area (hereinafter WA) sets forth the requirements for the vehicles that wish to cross the state border, with regard to reserving a place in the queue, waiting in queue, use of the border crossing WA and the direction to the road border crossing point.

1.2. The vehicles belonging to category A, B, C, or D that wish to cross the state border are directed to the WA to ensure road safety, decrease harmful effect to the natural environment, organise entry of vehicles in a road border crossing point and ensure public order.

1.3. The Regulation for the use of border crossing waiting area is prepared on the basis of the State Borders Act, the statute of database of border crossing queue, the contract under public law entered into between the Ministry of the Interior and Paldiski Sadamate AS, and the legislation of the Republic of Estonia.

1.4. It is mandatory for the person and the vehicle staying in the WA to follow the Regulation for the use of WA.

1.5. WA operates twenty-four hours a day and provides services for the vehicles crossing the Koidula road border crossing point exiting Estonia.

1.6. Koidula border crossing point WA is located on the territory of Paldiski Sadamate AS in Koidula village, Setomaa Parish, Võru County.

2. BORDER CROSSING QUEUE OF VEHICLES

2.1. A border crossing queue of vehicles shall be organised pursuant to reserving a place for a vehicle in the queue.


2.2. The vehicles crossing the border exiting Estonia must previously register themselves in the database of border crossing queue (hereinafter Database) or register the vehicle to the general queue in the location of WA. Registering to the border crossing queue and passing through the WA are mandatory.

2.3. No registering in the Database of border crossing queue shall be necessary for those vehicles which are not power-driven vehicles for the purposes of the Traffic Act or buses providing regular services on a fixed route for the purposes of the Public Transport Act (subsection 85 (6) of the State Borders Act).

2.4. The registration in the Database of border crossing queue and the use of the WA are subject to a fee, excluding the case where the vehicle belonging to category B uses a self-service kiosk and passes through the WA within 15 minutes.

2.5. If the vehicle belonging to category A, B, C, or D arrives to the road border crossing point without reserving a place in the border crossing queue or has reserved a place in the border crossing queue on an incorrect basis, it shall be redirected from the border crossing point back to reserve a place in the queue. It is not possible to register the vehicle for the border crossing queue when at the border crossing point.

2.7. If the vehicle arrives to the WA without reserving a place in the border crossing queue, it can do so in the border crossing WA by either using a self-service kiosk (category B only), calling the booking contact number +3726989192, using the websites www.eestipiir.ee or www.estonianborder.eu, or registering a place in the queue with the service staff of the WA.

2.8. The procedure, requirements and legal bases for reserving a place in the border crossing queue are listed on the websites www.eestipiir.ee and www.estonianborder.eu.

2.9. The fee for reserving a place in the border crossing queue in the WA can be paid in cash or by bank card using a payment terminal.

2.10. Trucks carrying goods must submit a MRN number of a customs document or declare that they cross the border without carrying goods.

2.11. If a truck was registered to the border crossing queue without carrying goods, the truck is allowed to cross the border only in the case it does not carry any goods.

2.12. A place in the border crossing queue with priority may be reserved:

a) for a vehicle which carries a member of an international delegation or an employee of a foreign diplomatic representation or consular post;
b) for a vehicle the cargo of which is time-sensitive goods for the purposes of subsection 591 (2) of the Customs Act;
c) for a vehicle which has a right to cross the border with priority arising from an international agreement or treaty;
d) for a motorcycle in category A or A1;
e) or a vehicle with regard to which there is another good reason or urgent need for border crossing.

A place in the border crossing queue with priority may be requested at the WA, on the websites www.eestipiir.ee and www.estonianboarder.eu, or by calling the booking contact number +3726989192. The vehicle that has applied for a place in the border crossing queue with priority will be allowed to proceed from the WA to the border crossing point as soon as possible.

2.13. In an instance false data is provided when reserving a place in the queue, the reservation of the place in the queue shall be cancelled and the vehicle must register again in the Database of border crossing queue.

2.14. A police authority may allow a vehicle into the road border crossing point without reserving a place in the queue and passing the border crossing WA if it is necessary for the purposes of public order, national security or public health or if it is due to a work-related need or if it arises from the law, an international agreement or international custom or any other public interest. In such case, no fee shall be charged for using the border crossing WA.

3. VEHICLES ARRIVING AT THE WAITING AREA

3.1. When arriving at the WA, the vehicle can be registered while in the border crossing queue (vehicles in category B at a self-service kiosk, by calling the booking contact number +3726989192, on websites www.eestipiir.ee and www.estonianborder.eu, or with the service staff of the WA; vehicles in category A, C, and D by calling the booking contact number +3726989192 on websites www.eestipiir.ee and www.estonianborder.eu, or with the service staff of the WA), the vehicle shall receive a unique queue number and it is registered as being arrived at the WA. The vehicles that have reserved a place in the border crossing queue beforehand are registered as being arrived at the WA by using a digital number reader at the entry gate or with the service staff of the WA. The vehicles are later directed to the border crossing point on the basis of their queue number.

3.2. The vehicles belonging to categories A, B, or D must arrive at the WA no later than by the time of commencement of direction to the border crossing point. In an instance of arriving at a later time, there is no guarantee of the vehicle being directed to the border crossing point by the time at which the place in border crossing queue was reserved.

3.3. The vehicles belonging to category C that have previously reserved a place in the border crossing queue must arrive at the WA no lather than within 3 hours before the commencement of direction to the border crossing point. In an instance of arriving at a later time, there is no guarantee of the vehicle being directed to the border crossing point by the time at which the place in border crossing queue was reserved.

3.4. When reserving a place in the border crossing queue, data is entered into the Database regarding the driver of the vehicle, the person and goods transported by the vehicle, the vehicle itself, the border crossing point, the waiting area, and the purpose of travel. The person submitting the data to the Database is the person applying for the reservation of a place in the border crossing queue.

3.5. The documents forming the basis of entering data into the Database include the following:

3.5.1. Valid travel documents of the driver of the vehicle and the person transported by the vehicle that prove the border crossing;
3.5.2. Valid registration certificate of the vehicle;
3.5.3. Documents proving the priority reservation of a place in the border crossing queue;
3.5.4. If there are declarable goods in the vehicle, the MRN number of an outgoing customs document (transit or export) shall be entered. The document with the entered MRN number will be checked in the border crossing WA.
3.5.5. If there are no goods to be declared, the vehicle is registered to the border crossing without goods.
3.5.6. Other submitted documents and certificates.

3.6. When submitting the source documentation, a person submitting it is responsible for the correctness of the submitted data and the data in the source documents.


3.7. If an authorised processor identifies incorrect data in the Database or if he or she has received reports of such data being submitted inadvertently, he or she will immediately organise for the correction of the data and, if possible, add a reference to the Database indicating to a document with correct data.

3.8. Free information about the reservation, estimated waiting time in the queue, and an estimated time at which point the vehicle is directed from the WA to the border crossing point is available from the service staff of the WA as well as on websites www.eestipiir.ee and www.estonianborder.eu.

3.10. When arriving at the WA, the driver is obligated to do the following:

 

3.10.1. Follow the traffic control devices when driving into the WA, inform the service staff/security of his or her arrival at the WA and whether the data about the vehicle applied for a place in the queue and the data of the driver have been entered into the Database;
3.10.2. Inform the service staff/security of the WA if the vehicle transports dangerous goods, time-sensitive goods, or if the vehicle has other priority border crossing rights pursuant to the State Borders Act;

3.10.3. Place the vehicle to a parking space indicated by the service staff/security of the WA or follow the traffic control devices;
3.10.4. Drive the vehicle on the territory of WA at a speed that does not exceed 10 km per hour;
3.10.6. Follow the information directed to drivers at the WA, including the information indicating when the time arrives for the vehicle to drive from the WA to the road border crossing point.

3.11. Access to the WA without registration is allowed under exceptional circumstances, which may include accident or fire, attempted assault or attack on objects located on the territory, natural disaster or other circumstances caused by forces of nature, and for transport vehicles servicing the WA.

3.12. Vehicles are positioned in the WA according to categories and with a possibility to leave without being dependent on other vehicles.

3.13. Vehicles that carry dangerous goods (e.g. ADR goods) will be directed to a separate part of the WA which has an additional access for rescue service.

4. VEHICLES’ STAY IN THE WAITING AREA

4.1. After the vehicle has been positioned in the place indicated by the service staff/security of the WA, the driver is entitled to use the following services in the WA:

a) to park the vehicle in the WA;
b) to dispose of the municipal waste accumulated during the trip and during the use of WA;
c) to get information from the Database regarding the reserved place of the vehicle, estimated waiting time in the queue, estimated border crossing time and information about being directed to the border crossing point based on the queue number or the vehicle registration number;

d) to use WC;
e) to use the free Wi-Fi zone.

4.2. To use the paid services provided in the WA:

a) customs agency services;
b) cafe;
c) showers;
d) park in the WA outside the permitted time limit.

4.3. The WA provides services in Estonian, English and Russian.

4.4. The persons staying in the WA are obligated to do the following::

4.4.1. to observe and fulfil the requirements of the current Regulation and the traffic control devices (road markings, traffic signs);
4.4.2. to fulfil the legal requests of the WA staff and security;
4.4.3. to maintain order and cleanliness, to use the property and equipment of the WA with care;
4.4.4. to observe the information displayed on the electronic display.

4.5. It is forbidden for the persons staying in the WA to:

4.5.1. bring into the WA:

a) narcotic substances;
b) toxic and poisonous substances (unless as cargo);
c) other substances that may cause an explosion, fire or other emergency situation;

4.5.2. obstruct the traffic of other vehicles and to ignore the requirements of traffic control devices (road markings and traffic signs);
4.5.3. ignite an open fire;
4.5.4. perform major repairs to the transport vehicles;
4.5.5. refuel;
4.5.6. pour petroleum products into waste bins;
4.5.7. position transport vehicles in the area that leak fuel or oil;
4.5.8. consume alcoholic beverages in the WA.

4.6. If the requirements of the current Regulation are violated and thereby, financial loss is caused, the persons at fault shall reimburse the full amount for all losses caused to the owner of the WA. Pursuant to clause 4.5.7. of the Regulation, the representative of the waiting area is entitled to impose, in addition to the reimbursement of losses, a fine for causing oil pollution: 14 € for an area of up to 30 cm2, 20 € for an area of up to 1 m2.

4.7. The WA service staff/security has the right to temporarily refuse a violator the access to the WA.

5. DEPARTURE OF VEHICLES FROM THE WAITING AREA

5.1. A vehicle has a right to drive to the border crossing point after the relevant data is displayed on the WA display board and after the driver has settled the financial obligations towards the WA except for a vehicle belonging to B category using the self-service kiosk to take a queue number and which stayed in the WA for less than 15 minutes.

5.2. When departing the WA, the vehicle is checked against the queue number to verify the vehicle’s right to cross the border. If a vehicle wants to exit the WA before the time has come to cross the border with an intention to not cross the border, the driver must notify the fact to the WA service staff/security.

5.3. The departure of vehicles from the WA is allowed, provided that the WA service staff/security is informed about it. If a vehicle returns to the WA before the time it is sent to the border, the vehicle retains its place in the border crossing queue. If not, a new registration into the border crossing Database and a new payment for the WA must be made.

5.4. If a truck or a (semi)trailer needs to be replaced, the driver will submit a written request to the WA service staff and include a copy of the technical passport of the truck or (semi)trailer. The vehicle’s position in the border crossing queue is retained, if it still carries the same goods (the same MRN number) which were declared when the reserved position in the line was taken.

5.5. The vehicles which did not pass the customs control and return to the WA will be given a new border crossing time by the WA service staff. If the border is not crossed or the vehicle is sent back from the border crossing point customs control zone (regardless of the reason), the WA service is deemed to have been provided and the paid sum will not be refunded.

5.6.  If the time arrives for a vehicle to leave the WA and the vehicle fails to make an appearance, the WA service staff has to clarify the reason. Upon a justified request of the driver to prolong the vehicle’s stay on the WA, the WA service staff has the right to and may allow such prolongation. In such case the vehicle is moved to the next free place in the queue and the driver is obligated to pay a parking fee outside the time limit indicated in clause 6.1. pursuant to valid rates. If for some reason the departure of the vehicle from the WA has not been registered, the reservation and the related queue number shall be cancelled.

6. WAITING AREA FEES

6.1. The WA service provider shall charge fees for using the border crossing WA and reserving a place in the queue according to the valid price list. This fee gives the client the right to use the WA services within 24 hours before heading to the border crossing point and within 12 hours after it.

6.2. The WA can be used as an additional service outside the time limit prescribed in clause 6.1 for which the operator of the WA may charge a parking fee.

6.3. The parking fee for the vehicles in the waiting area earlier than 24 hours before heading to the border crossing point and later than 12 hours after it, is as follows:

a) cars and buses (9 to 17 seats)

• hour 1,00 Euro;
• first day 5.00 Euros;

• each following day 4.00 Euros;

b) truck transport/trailers/buses (18 seats or more)

• hour 2.00 Euros;
• first day 20.00 Euros;

• each following day 15.00 Euros.

6.4. The hourly fee for parking is charged for every hour that has started if the truck is parked 24 to 48 hours before heading to the border crossing point and/or 12 to 24 hours after it.

6.5. The daily fee for parking is charged for each day that has started if the truck is parked more than 48 hours before heading to the border crossing point and/or more than 24 hours after it.

6.6. Other paid services in the WA are provided according to the valid price list.

6.7. The price list of WA services is available at the service provision point in the WA as well as on the websites www.eestipiir.ee and www.estonianborder.eu.

6.8. The following options can be used to pay for the usage of the border crossing WA and for reserving a place in the queue:

a) via bank link or by credit card on the websites www.eestipiir.ee or www.estonianborder.eu;
b) via phone by calling the booking contact number +3726989192 – to pay for the service using a phone, an Estonian phone number must be used to make the call and it is required to have enough credit limit;
c) at the WA it is possible to pay in cash or by bank card using a payment terminal.


 

6.9. The services of reserving a place in the border crossing queue and the services of WA are valid once the payment has been made.

 

6.10. After a successful reservation, a one-time free notification is delivered to the client at his or her request either via e-mail, SMS message, or phone according to the option chosen by the client.

6.11. Refunding the WA fee

6.11.1. If the place in the queue is not used, the WA fee can be cancelled and left as a prepayment or claimed for refund. In the following cases the fee shall not be refunded or left as a prepayment:

a) the fee of 1 (one) Euro for using the border crossing WA by the vehicle belonging to category A or the fee of 3 (three) Euros for using the border crossing WA by the vehicle belonging to category B shall not be refunded or left as a prepayment if the place in the border crossing queue was not used or the place in the border crossing queue was cancelled within less than 24 hours before the planned time of border crossing;

b)  the fee of 14 (fourteen) Euros for using the border crossing WA by the vehicle belonging to category C or the fee of 14 (fourteen) Euros for using the border crossing WA by the vehicle belonging to category D shall not be refunded or left as a prepayment if the place in the border crossing queue was not used or the place in the border crossing queue was cancelled within less than 48 hours before the planned time of border crossing;

c) the fee left as a prepayment can be used within 6 months of the cancelling date;

d) the fee for reserving a place in the border crossing queue is not refunded if the place in the border crossing queue was not used or if it was cancelled.

Queues and types

 

  • Reserve for certain time
    By registering in the queue, you can choose the time when you want to cross the border. Note that if an unexpected decrease or increase in border capacity occurs, then the booked time will be, if possible, kept unchanged at the expense of other queues (except priority queues).
  • Priority Queue
    You will have to prove your right for a Priority queue slot at the border.
  • Booking for the first available time
    А certain part of the normal border capacity is allocated, so it is advisable to use a reservation for a certain time or priority. Note that if an unexpected decrease or increase in border capacity occurs, then waiting time will be increased or decreased accordingly.
